NDPS Sampling and FSL: Procedural Safeguards

Section 52A of the NDPS Act and the NDPS (Regulation of Controlled Substances) Rules govern sampling and disposal of seized substances.

Sampling Requirements

Samples must be drawn in the presence of the accused or a witness. Proper sealing and forwarding to the FSL within the prescribed time is mandatory.

FSL Analysis

The Forensic Science Laboratory analyses samples to determine the nature and quantity of the substance. Delay or tampering can vitiate the prosecution case.

Defence Implications

Non-compliance with sampling and FSL procedures can be a ground for bail and defence during trial. Courts have quashed proceedings for serious procedural lapses.
