ED Attachment of Property: Legal Remedies

The Enforcement Directorate can attach properties suspected to be proceeds of crime under the Prevention of Money Laundering Act.

Provisional Attachment

The ED can provisionally attach property for 180 days. The Adjudicating Authority must confirm the attachment within this period.

Confirmed Attachment

If confirmed, the property remains attached pending trial. The accused can appeal before the Appellate Tribunal.

Legal Remedies

Challenges can be made before the Adjudicating Authority, Appellate Tribunal, and High Court. Grounds include lack of nexus with proceeds of crime and procedural non-compliance.
