Anticipatory Bail in NDPS Cases: Legal Framework

Anticipatory bail allows a person to seek bail before arrest, in apprehension of arrest. In NDPS cases, the interplay between Section 438 CrPC and Section 37 NDPS Act is complex.

Section 438 CrPC

The provision allows the High Court or Court of Session to grant anticipatory bail if the court is satisfied that the applicant has reason to believe they may be arrested for a non-bailable offence.

NDPS Override

For commercial quantity cases, Section 37 NDPS Act applies. Courts have held that the twin conditions of Section 37 must be satisfied even for anticipatory bail in such cases.

When to Apply
